On 26 July 2016, the Italian Ministry of Health published Decree 142 of 31 May 20161 in the Official Journal of Italy, amending the Health Ministry Decree of 21 March 1973 (“DM 21 March 1973”) on the Hygiene rules for packaging, containers and utensils intended to come into contact with foodstuffs or personal-use products. The amendment only concerns the section on regenerated cellulose objects. The Decree has become effective since 10 August 2016.
Decree 142 of 31 May 2016 is a transposition of Directive 2007/42/EC2 related to materials and articles made of regenerated cellulose film intended to come into contact with foodstuffs. It adopted all the requirements stated in Directive 2007/42/EC with additional national requirements.
Synthetic casings of regenerated cellulose is not in the scope of Directive 2007/42/EC, whereas, the scope of Decree 142 of 31 May 2016 includes synthetic casings of regenerated cellulose. The Decree is applicable to synthetic casings of regenerated cellulose provided that the casings of regenerated cellulose are plasticized with glycerine. Also, such casings must be washed in a method that the maximum glycerin content does not exceed 13 %. The Decree did not state the method for washing glycerin.
Decree 142 of 31 May 2016 repeals several Decrees including Decree 556 of 10 July 19943, Decree 230 of 10 May 20064 and Decree 538 of 17 December 19995, Article 1, paragraph 3.
